Rental Agreement Form and Release of Liability
- I accept for use “as is” the equipment listed on this form,
and accept full responsibility for the care of the equipment while
it is in my possession.
- I will be responsible for the replacement at full retail
value of any equipment rented under this agreement form, but not
returned to BUCKLES & BOARDS. Please lock skis or snowboard
at all times.
- I agree to reimburse and hold harmless BUCKLES & BOARDS
for any loss or damage of any kind, other than reasonable wear
and tear (not to include rock damage) which results from the use
of this equipment.
- I agree to return all rental equipment to BUCKLES & BOARDS
by the due date and in clean condition to avoid any additional
charges.
- I agree that snow boarding and skiing are HAZARDOUS activities.
I recognize that injuries are a common and ordinary occurrence
of the activity. I herby agree to freely and expressly ASSUME
and accept ANY AND ALL RISKS OF INJURY OR DEATH while participating
in the Activity. Nonetheless, I voluntarily elect to participate
in the aforementioned Activity.
- I understand that the ski boot/binding system will not release
at all times or under all circumstances, nor is it possible to
predict every situation in which it will release, and is therefore
no guarantee for my safety. I am aware that the snowboard/boot/binding
system IS NOT DESIGNED OR INTENDED TO RELEASE. As such, I herby
freely agree to assume and accept any and all unknown risks by
participating in this activity.
- I hereby release BUCKLES & BOARDS from any and all liability
for damage and injury to myself or any personal property resulting
from the selection, adjustment, and use of this equipment, accepting
myself the full responsibility for any and all damage or injury
which may result.
- I have made no misrepresentation to BUCKLES & BOARDS
regarding my ability, height, weight, or age.
- I will verify the visual indicators on my bindings correspond
to the settings shown on this rental agreement form.
- All instructions on the use of my rental equipment have been
made clear to me, and I understand the function of my equipment.
- Rentals and rental reservations are Non-refundable
In the event any section of this release is found to be unenforceable,
the remaining terms shall be fully enforceable.
- This Release shall be binding to the fullest extent permitted
by law.
- This release shall be binding upon my assignees, subrogors,
distributes, heirs, next-of-kin, executors, personal representatives,
and administrators and may be pled by the shop as complete bar
and defense against any claim, demand, action or causes of action
by or on behalf of the Renter.
- I understand that by continuing through this that I am over
18 years of age and can legally be bound to a contract
